Terms of use

Thanks for using HabitCrab. These terms set out the agreements between you and us. By creating an account, you agree to them. Please also read our privacy policy.

1. Who we are

HabitCrab is a product of Totem Traffic [LEGAL FORM], registered with the Dutch Chamber of Commerce under number [COC NUMBER], located at [ADDRESS], the Netherlands. You can reach us at support@habitcrab.com.

2. What is HabitCrab?

HabitCrab is an app in which you create your own hermit crab. The crab responds to how much you scroll and whether you reach your goals, such as steps, exercise and sleep. Friends you add can see your crab.

3. No medical advice

HabitCrab helps you with habits. The default goals are based on research and guidelines, but the app is not a medical device and does not give medical, psychological or nutritional advice. If you have doubts about your health or have symptoms, contact your doctor. Adjust your goals to what is achievable and safe for you.

4. Your account

• You must be 16 or older to use HabitCrab.
• You provide accurate information and keep your account to yourself.
• You are responsible for what happens with your account.
• You can delete your account at any time in the app via Settings › Delete account.

5. Together with friends

HabitCrab is meant for encouraging each other. So we agree that:

• You do not use the app to bully, harass or insult others, for example through your crab’s name or your display name.
• You do not choose names that are offensive, misleading or unlawful.
• You can always remove, block or report friends. We review reports and may change names or block accounts if someone does not follow these rules.

6. Subscriptions and payments

[FINALISE ONCE PRICING IS SET]

• Some features are only available with a paid subscription, which you buy through Apple’s App Store. Apple handles the payment, and Apple’s terms apply to it.
• A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
• You manage and cancel your subscription on your iPhone: Settings › [your name] › Subscriptions. Deleting your account does not cancel your subscription with Apple, so cancel it there as well.
• With a free trial, the subscription is charged automatically at the end of the trial unless you cancel in time.
• Apple’s policy applies to refunds.

7. Intellectual property

The app, the crab, the illustrations, the texts and the HabitCrab brand belong to us or our licensors. You may use the app for personal use. You may not copy, sell or imitate it.

8. Availability and changes

We do our best to keep HabitCrab working well and without interruptions, but we cannot guarantee this. We may add, change or discontinue features. We will let you know in good time about major changes to paid features.

9. Liability

You use HabitCrab at your own risk. To the extent permitted by law, we are not liable for indirect damage or for damage resulting from following a goal in the app. Our total liability is limited to the amount you paid for HabitCrab in the preceding 12 months [CHECK]. This does not apply in case of intent or gross negligence on our part, and does not affect your statutory rights as a consumer.

10. Termination

You can stop at any time by deleting your account. We may block or delete your account if you seriously or repeatedly fail to comply with these terms.

11. Changes to these terms

We may change these terms. We will notify you in the app in advance of important changes. If you continue to use HabitCrab after that, the new terms apply.

12. Governing law

These terms are governed by Dutch law. If you are a consumer in another EU country, you keep the protection of that country’s mandatory rules. If we cannot resolve a dispute together, the competent court in the Netherlands will decide, unless the law provides otherwise.
